KUCHING: Asteel Group Bhd’s wholly-owned subsidiary Asteel (Sarawak) Sdn Bhd (ASWK) has again turned to Asian International Arbitration Centre in its bid to recover about RM723,106 in outstanding payment for works done from Dynaciate Engineering Sdn Bhd.
Asteel said ASWK had on December 8 issued a notice of arbitration under Rule 5 of the Asian International Arbitration Centre (Malaysia) Arbitration Rules 2012 to Dynaciate seeking remedy(ies) on unpaid balance together with interest amounting to RM723,106 as at October 31, 2024.The unpaid sum was related to roofing and installation works carried out by ASWK for the Sarawak methanol project in Bintulu.
ASWK was appointed as a sub-contractor by Dynaciate to carry out steel structure erection work, equipment erection work, AG piping erection work and roofing & cladding installation work for the methanol project in 2022.
ASWK had initiated adjudication proceedings against Dynaciate under the Construction Industry Payment and Adjudication Act 2012 (CIPAA) on June 16, 2025. ASWK was claiming against Dynaciate for the outstanding progressive claims and overdue interest amounting to about RM7.72 million.
The adjudicator had ruled in favour of ASWK in the first two cases, and Dynaciate was asked to pay about RM1.793 million and RM966,077 respectively. In addition, Dynaciate had to pay ASWK RM81,161 and RM115,562 respectively as cost of the adjudication proceedings.
On November 28, the adjudicator dismissed ASWK’s adjudication claim against Dynaciate in the third case, and ASWK was ordered to pay RM11,500 as costs of the adjudication proceedings within 30 days from that day.
