KUCHING: A 30-year-old man was sentenced to 12 months’ imprisonment by the Magistrates’ Court here on today for stealing a motorcycle in Batu Kawa last month.
Magistrate Nursyaheeqa Nazwa Radzali sentenced Muhammad Nazri Abdullah after he was convicted of the charge under Section 379A of the Penal Code, read together with Section 34 of the same Code.
He was ordered by the court to undergo the prison sentence from the date of the conviction (May 6).
The offence carries a jail term of between one and seven years, and is also punishable with a fine.
According to the charge, the accused, together with two accomplices still at large, stole a blue Honda Wave Alpha motorcycle belonging to a woman at the parking area near Jalan Batu Kawa Matang at about 10.40am on April 12.
The victim had earlier parked her motorcycle in a locked condition in front of her workplace.
However, at about 2pm the same day, she was informed by her employer that the motorcycle had gone missing. The estimated loss was RM5,000.
A police report was subsequently lodged but initial efforts to locate the vehicle were unsuccessful.
Investigations later led to the arrest of the accused on April 29 at a house in Kampung Skibang, Bau during an operation by a task force from the Padawan district police headquarters.
During the arrest, police seized several items believed to be linked to the case, including a modified Allen key, a bag and a Proton Iswara car suspected to have been used during the theft.
Police investigations also found that the accused was identified through closed-circuit television (CCTV) footage at the scene, which captured the act of stealing the motorcycle.
It is understood that the accused, who is divorced and unemployed, is the eldest of five siblings and lives with his parents in Bau.
Deputy public prosecutor Muhammad Afiq Safly Nor Kazly prosecuted the case while the accused was unrepresented.
