SIBU: A 53-year-old man was sentenced to 14 years’ imprisonment and four strokes of the cane by the Sessions Court here today after pleading guilty to raping a 22-year-old woman with disabilities (OKU) in Kapit two months ago.
Judge Musyiri Peet ordered Onjok Magot to serve the prison sentence from July 9, the date of his arrest, after the accused admitted to committing the offence.
Onjok was charged with raping the victim at a rented room in Kampung Baru, Kapit, at about 5.30 pm on June 8.
He was charged under Section 376(1) of the Penal Code, which carries a maximum sentence of 20 years’ imprisonment and whipping upon conviction.
According to the facts of the case, the complainant was informed that the accused had gone to the rented room occupied by the victim on the day of the incident. Upon arriving at the scene, the complainant found the accused wearing only his underwear before he fled.
Suspecting that the victim had been raped, the complainant lodged a police report, prompting an investigation by the authorities.
Investigations revealed that the accused had gone to the room shared by the victim and her mother with the intention of sexually assaulting the woman. He allegedly ordered the victim’s mother to leave the room before raping the victim.
Police arrested Onjok at about 9.30 pm on July 9, at an eatery along Jalan Temenggong Jugah, Kapit.
Deputy Public Prosecutor Cynthia Emmelda Jerry prosecuted the case, while the accused was unrepresented.
The court’s decision reflects the seriousness with which the justice system treats sexual offences involving persons with disabilities, recognising the vulnerability of victims and the need for deterrent punishment.
