Man jailed 13 months for assault, drug use

KUCHING: A 39-year-old man was sentenced to RM1,800 fine in default four months imprisonment and nine months imprisonment by the Magistrate’s Court here today for assaulting a woman and self-administering dangerous drugs.

Mohammad Shairi Abdullah pleaded guilty to both charges before Magistrate Nursyaheeqa Nazwa Radzali.

On the first charge, the court fined him RM1,800 or in default four months imprisonment.

The court heard that Shairi had voluntarily caused hurt to a 22-year-old complainant, by punching her face and arms inside a car at Kampung Bintawa Ulu at about 11 pm on August 16.

The offence was committed under Section 323 of the Penal Code, which carries a maximum jail term of one year, or a fine of up to RM2,000, or both, upon conviction.

Based on the facts of the case, the victim had asked Shairi to send her to her aunt’s house in Tabuan Jaya.

During the journey, an argument and physical altercation broke out between them inside the vehicle.

The victim suffered bruising to her face, right forearm and the back of her left arm as a result of the incident.

Police later arrested Shairi at a house in Kampung Sungai Bedil Besar, Petra Jaya, at about 12.20 pm on August 18.

In a separate case, Shairi was sentenced to nine months in prison after pleading guilty to self-administering amphetamine and methamphetamine.

He tested positive for amphetamine and methamphetamine at the Narcotics Crime Investigation Division office at Kuching District Police Headquarters at about 2.20 pm on March 11.

The offence was charged under Section 15(1)(a) of the Dangerous Drugs Act 1952 and punishable under Section 15(1) of the same Act.

The court heard that a urine test conducted on Shairi tested positive for amphetamine and methamphetamine.

The urine sample was subsequently sent to the Sarawak General Hospital Department of Pathology Drug and Research Laboratory for analysis.

The laboratory report confirmed the presence of both dangerous drugs, which are listed under the First Schedule of the Dangerous Drugs Act 1952.

Besides the nine-month jail term, the court also ordered Shairi to be placed under police supervision for two years upon completion of his sentence, in accordance with Section 38B of the Act.

Prosecution officer, Inspector Siti Radhiah Abdul Rahman, appeared for the prosecution in both cases. Shairi was unrepresented.
