KUCHING: Fourteen people were each fined RM3,500 in default 12 months’ jail by the Serian Magistrate’s Court today for taking part in a riot armed with two stones at a road junction in Kampung Resak, Serian, last month.
All the accused pleaded guilty to the charge under Section 148 of the Penal Code before magistrate Nursyaheeqa Nazwa Radzali.
The 14 accused charged under Section 148 were Luke Juweng Tuyang, 31; Noyet Nyangai, 56; Dianati Silon, 38; Devy Silon, 35; Ranand Nyangai, 58; Chari Masigan, 54; Pisi Gambar, 47; Landy James, 35; Roy Silon, 34; Stanley Zainal, 30; Milton Donny Ruose, 28; Musa Nitap, 26; Amri Nitap, 23; and Morientes Angit, 23.
The court also fined Amri and Landy RM4,000 each in default eight months’ imprisonment for committing mischief by damaging a Proton Saga under Section 427 of the Penal Code.
The sentences for the two men were ordered to run consecutively, which brings the total fine for Amri and Landy to RM7,500 in default 20 months’ jail.
The court heard that the incident occurred at about 10.33pm on Aug 28 near the junction of Kampung Resak.
The 14 accused had gathered and taken part in a riot on a public road while armed with two medium-sized stones.
The court was also told that the incident stemmed from accusations involving the alleged theft of oil palm fruit, with the parties involved coming from the same village.
During the incident, the rear windscreen of a yellow Proton Saga was kicked and smashed, causing damage estimated at RM4,361.
One of the passengers in the Saga also sustained minor injuries after being struck by glass from the shattered window.
Police subsequently arrested the accused at about 12.30am on Aug 29 near the Kampung Resak junction.
The prosecution was conducted by Deputy Public Prosecutor Muhammad Aidil Akmal Sharidan, while all the accused were unrepresented.
