KUCHING: The Magistrates’ Court here today(Sep 21) fined a 35-year-old man RM900, in default two weeks’ imprisonment, for voluntarily causing hurt to another man following grave and sudden provocation.
Magistrate Leona Dominic Mojiliu imposed the fine on Jodi Aryanto after he pleaded guilty to a charge under Section 334 of the Penal Code.
The accused was charged with causing hurt to 50-year-old Jong at a repair centre near Jalan Ensing Timur, Jalan Batu Kawa, at about 11am on Aug 11.
The court heard that Jong had gone to the repair centre to enquire about the condition of the lights on his Perodua vehicle, which he claimed had turned yellow and fallen from their original position.
During the incident, Jong questioned Jodi about the condition of the vehicle’s lights while pointing at them with his index finger.
The action allegedly provoked Jodi, resulting in an argument between the two men.
Jodi then punched Jong on his left eye and left eyebrow, causing him to fall to the floor.
Following the incident, Jong lodged a police report.
Under Section 334 of the Penal Code, a person convicted of voluntarily causing hurt on grave and sudden provocation may be punished with imprisonment for a term of up to one month, or a fine of up to RM1,000, or both.
Deputy Public Prosecutor Nurul Aqila Morsalin appeared for the prosecution, while Jodi was unrepresented.
