KUCHING: Two men, including an army personnel, pleaded not guilty at the Sessions Court here on Thursday (Sept 10) to possessing 38.62 grammes of methamphetamine in Serian.
The two accused, 40 and 35, entered their plea, when the charge was read before Judge Iris Awen Jon.
They were charged with jointly possessing the dangerous drug at about 6.40pm on May 16, at the roadside of Jalan Muara Mongkos near the palm oil plantation in Serian.
The charge was framed under Section 12(2) of the Dangerous Drugs Act 1952 and punishable under Section 39A(2) of the same Act, read together with Section 34 of the Penal Code.
Under Section 39A(2), an offender is liable to imprisonment for life or a term of not less than five years, and whipping of not less than 10 strokes.
No bail was offered by the prosecution pursuant to Section 41B of the Dangerous Drugs Act 1952.
The court has fixed Oct 9 for the pre-trial case management. The court subsequently ordered the accused to be further remanded at Puncak Borneo Prison pending disposal of the case.
Deputy public prosecutor Chuah Kai Sheng appeared for the prosecution. The army personnel was represented by counsel Osman Ibrahim while the other accused was unrepresented.
