Bintulu Port wins leave for judicial review

KUCHING: Bintulu Port Holdings Bhd (BPHB) has obtained leave from the Kuala Lumpur High Court to proceed with 

its judicial review application 

on the notices of assessment from Inland Revenue Board (IRB).

BPHB was slapped with notices of assessment for 2020 (about RM6.75 million), 2021 (RM10.99 million), 2022 (RM12.67 million) and 2023 (RM13.8 million) by the IRB on July 31, 2025. 

The company, which was represented by Messrs Shearn Delamore & Co as its legal counsel, filed the judicial review application on August 15. 

The court also granted BPHB an interim stay of proceedings until the hearing date on September 25, which means during the interim stay period, BPHB is not required to remit the disputed taxes and penalties totalling about RM44.2 million to the IRB.

On September 25, the court hearing was converted to case management to allow BPHB to file an affidavit in reply to the IRB’s affidavit. 

The court issued the following directions: (a) BPHB is to file and serve its affidavit in reply (in relation to the stay application) by October 6 2025, and (b) the hearing for the inter partes stay application is fixed for November 20, 2025.

“The interim stay granted on August 28, 2025 shall remain in effect until the inter partes stay application is heard and a decision is rendered by the court. As such, BPHB is not required to settle the disputed tax assessments and penalties amounting to RM44.2 million until further order by the court,” the company said in a filing with Bursa Malaysia.
