SIBU: Sibu Member of Parliament, Oscar Ling Chai Yew, urges all business owners here, especially those who have already hired employees, are planning to hire employees, or are about to dismiss employees – including companies and sole proprietors – to promptly complete the necessary declaration procedures to ensure that their business activities comply with legal requirements and to avoid violating relevant regulations.
He revealed that the Sibu Labour Department recently conducted surprise inspections and found that some businesses failed to fulfill their employee declaration obligations as required.
“This indicates that certain business operators, particularly long-established ones, still lack sufficient awareness of the relevant laws,” he said in a statement today.
Ling pointed out that, according to Section 60A of the Sarawak Labour Ordinance, all business activities related to agriculture, timber, or associated industries – whether starting a new business, taking over an existing one, changing the business name, or relocating the business premises – must submit a declaration to the Labour Department within 90 days if the business involves hiring, planning to hire, or dismissing employees.
“This is a statutory obligation,” he said, adding that it must be taken seriously by all relevant businesses.
Ling emphasised that employers who were found not to have completed the declaration process during Labour Department inspections might face fines.
He added that the declaration process was not complicated, and business owners could download the required form from this link: https://www.jtkswk.gov.my/v2/wp-content/uploads/2022/12/BORANG_MAKLUMAT_OPERASI_PERNIAGAAN_60A.pdf.
Once completed, the form should be submitted to Sibu Labour Department (Pejabat Tenaga Kerja Sibu) at 3rd Floor, Federal Building Block 3, Brooke Drive.
“Business owners can also visit the service centre in person to obtain and complete the form. The service centre will provide full assistance to ensure you successfully complete the declaration process and operate your business in a legal and compliant manner,” Ling added.
