KUCHING: Cahya Mata Sarawak Bhd (CMS) Deputy Chairman, Datuk Seri Mahmud Abu Bekir Taib, has filed a lawsuit against the company over a request to inspect its accounts.
The conglomerate said that Mahmud Abu had served an originating summons (OS), dated March 5, 2025, against CMS at the Kuching High Court.
“This OS arose from certain requests by Mahmud Abu to Cahya Mata for the inspection of accounts. Cahya Mata informed Mahmud Abu that due to the short notice, another time needed to be set to facilitate the inspection. However, Mahmud Abu did not wait for the board of directors’ decision on the time and place for the inspection and instead chose to file this OS,” the company said in a filing with Bursa Malaysia.
Subject to further modifications and additions in the course of the proceedings, the OS is seeking the following orders:
- That within seven days from the date of this order, Cahya Mata produce and open for inspection by a registered auditor, accountant, or an advocate acting for Mahmud Abu — subject to a written undertaking given to the court that the information acquired shall not be disclosed except to Mahmud Abu—all accounting and other records of Cahya Mata and its subsidiaries, namely:
- Cahya Mata Phosphates Industries Sdn Bhd;
- Cahya Mata Cement Sdn Bhd;
- Oiltools International Sdn Bhd;
- Cahya Mata Oiltools Sdn Bhd; and
- Cahya Mata Professional Sdn Bhd.
- That the registered auditor, accountant, or advocate acting for Mahmud Abu be granted liberty to take copies of the said accounting and other records, or alternatively, that Cahya Mata provide photocopying facilities at a rate of 10 sen per copy if required.
- Costs, and;
- Any further orders deemed fit and just by the court.
CMS said that it is consulting its legal advisors and will respond to the OS to protect the company’s interests.
“The OS is not expected to have any material impact on Cahya Mata’s earnings per share or net asset per share for the financial year ending December 31, 2025. It is also not expected to have a significant operational impact on Cahya Mata.
“Any further material developments regarding the OS will be announced to Bursa Securities accordingly,” CMS added.
