KUCHING: The Sessions Court here on Wednesday fined a company director RM3,000 in default three months imprisonment for possessing uncertified walkie-talkies with intent to sell.
Ting Leong Hieng, 50, pleaded guilty before Judge Afidah Abdul Rahman to the charge under Regulation 16(1)(b) of the Communications and Multimedia (Technical Standards) Regulations 2000, read together with Section 244(1)(a) of the Communications and Multimedia Act 1998, punishable under Regulation 16(3) of the same regulations.
If convicted, he could be fined up to RM300,000 or imprisonment of up to three years or both.
He was found in possession of three sets of Keruier walkie-talkies intended for sale, which were not certified as required by the Multimedia Communications (Technical Standards) Regulations 2000.
The offence was committed at his business premises on the ground floor of a shopping mall at Jalan Stutong here, around 11.20 am on October 11, 2023.
In a separate charge, Ting’s company was also fined RM5,000 for the same offence.
During mitigation, Ting, who is married with two children, pleaded for a lenient sentence as it was his first offence and he was unaware the items required a SIRIM certification.
He admitted purchasing the communication devices from Shopee to resell to customers.
However, Malaysian Communications and Multimedia Commission (MCMC) Prosecuting Officer, Siti Hajar Sulaiman, urged the court to impose an appropriate sentence to deter others from committing a similar offence.
