KUCHING: The Magistrates’ Court here today(Sep 21) sentenced a security guard to five months’ imprisonment and a RM1,000 fine, in default one month’s imprisonment, for hitting his colleague over the use of a company stamp.
Magistrate Nursyaheeqa Nazwa Radzali handed down the sentence to Thompson Dunssy, 44, after he pleaded guilty to the charge under Section 325 of the Penal Code.
Under Section 325, a person convicted of voluntarily causing grievous hurt may be punished with imprisonment for up to seven years and is also liable to a fine.
The court heard that Thompson committed the offence at about 9.30am on August 26 at a security office near Jalan Ensing Timur.
He had punched his colleague on the ring finger of his left hand after discovering that the victim had used the company stamp without first seeking his permission.
The incident resulted in the victim suffering a fracture to his ring finger.
In mitigation, Thompson pleaded for leniency and a minimum fine, telling the court that he was the sole breadwinner of his family.
He also said the victim had spoken harshly to him during the incident, causing the situation to escalate.
The prosecution was conducted by Prosecution Officer Inspector Siti Radhiah Abdul Rahman, while Thompson was unrepresented.
