Court acquits man charged with possessing 179g of cannabis

KUCHING: A man was acquitted and released by the Sessions Court here on Monday (Jan 12) over a charge of possessing 179.65g of cannabis, three years ago.

Aslahuddin Azwan Hud, 31, was cleared after his defence, led by defence attorney Osman Ibrahim, successfully raised reasonable doubt against the prosecution’s case at the close of the defence stage.

Judge Iris Awen Jon said in her ruling that Aslahuddin had informed the police he was unaware of the drugs inside the package he collected from a courier office.

Aslahuddin had previously been charged under Section 6 of the Dangerous Drugs Act (DDA) 1952, which carries a punishment of five to 30 years’ imprisonment and a minimum of 10 strokes of the cane under Section 39A(2) if convicted.

The alleged offence occurred in the parking lot of a courier office on Jalan Pending at about 3.45pm on May 23, 2023.

He was reportedly arrested after collecting a package from the courier company.

The accused told the police that the package was ordered via social media and was believed to contain a laptop, and he did not know it contained drugs.

On Aug 10, 2025, Aslahuddin was ordered to enter his defence after the court ruled that the prosecution had established a prima facie case.

Seven witnesses were called to give evidence during the proceedings.

The prosecution was handled by deputy public prosecutor Mohamad Aiman Mutallib Mohamad Shariff.
