Crucial to understand state’s legal history

KUCHING: The legal history of Sarawak and the Malaysia Agreement 1963 (MA63) must be understood and appreciated as a fundamental pillar that strengthens the state’s position within the Federation of Malaysia.

According to Professor Michael Leigh, MA63 was the lifeblood of the union between Sabah, Sarawak, Singapore, and Malaya that led to the formation of Malaysia.

“Meanwhile, the Cobbold Commission Report and the Inter-Governmental Committee (IGC) Report served as the foundation for Article VIII of the Malaysia Agreement, which guarantees Sarawak’s autonomy and special rights.

“Therefore, understanding Sarawak’s legal history and the Malaysia Agreement 1963 is essential to ensure the state’s rights continue to be upheld in the spirit of federalism built more than six decades ago,” he said when delivering his lecture titled “Sarawak Legal History and the Malaysia Agreement 1963” during The International Talk Series 2025 held here on Tuesday.

A renowned scholar who has extensively studied Sarawak’s history, Leigh shared his research findings based on official documents from the Sarawak State Library.

He said matters concerning immigration, religion, language, land and natural resources were accorded special privileges to Sarawak and Sabah. However, their implementation depended largely on the political strength and unity of the state’s leadership.

Leigh also acknowledged the contributions of former chief minister, the late Pehin Sri Adenan Satem and Premier Datuk Patinggi Tan Sri Abang Johari Tun Openg in reinforcing Sarawak’s position through continuous negotiations with the Federal Government.

Organised by the Sarawak State Attorney-General’s Chambers, the programme aimed to enhance understanding of the legal foundations that connect Sarawak, Sabah and the Federal Government.
