SIBU: The High Court here on Monday (March 30) ordered a delivery man to enter his defence on two drug-related charges after the court ruled that the prosecution had established a prima facie case against him.
Raymond Yew Her Hong, 21, was charged with trafficking 175.05 grames of methylenedioxymethampetamine (MDMA) in an apartment at Jalan Wong King Huo on June 12, 2023, at about 2.15 am.
The offence falls under Section 39B(1)(a) of the Dangerous Drugs Act 1952 and is punishable under subsection 39B(2) of the same Act.
The Act provides for the death penalty or life imprisonment, and if not sentenced to death, the offender shall also be given not less than 12 strokes of the cane on conviction.
Yew was also charged with having 109.83 grames of Ketamine at the same time and place, thereby committing an offence under Section 12(2) of the Dangerous Drugs Act 1952 and punishable under Section 12(3) of the same Act.
High Court Judge Wong Siong Tung ordered Yew to enter his defence for both charges, and fixed hearing for two two days from July 27.
Earlier, at the close of the prosecution’s case, Deputy Public Prosecutor (DPP) Mark Kenneth Netto submitted that the prosecution had proven a prima facie case.
He argued that the essential elements – possession (custody, control, knowledge), trafficking, and identity of the drugs had each been established at a prima facie level.
