Duo jailed 40 months each for break-in and theft

KUCHING: Two accomplices were each sentenced to 40 months’ imprisonment by the Magistrate’s Court today for breaking into a restaurant and stealing a cash register and a donation box early this January.

Mohd Asfia Bakar, 33, and Bathrim Haini, 28, both pleaded guilty when a joint charge was read before Magistrate Ling Hui Chuan.

According to the charge, they were jointly charged under Section 457 of the Penal Code, read together with Section 34 of the same Code.

They were accused of breaking into a restaurant at Jalan Satok here and stealing the cash register along with money from the donation box at about 7.14 am on January 5.

Based on the facts of the case, on the day of the incident, the male complainant was at home when he was contacted by a cook informing him that the restaurant had been broken into through the kitchen window.

A review of the closed-circuit television (CCTV) footage revealed that two men had broken in and taken both items.

A police report was lodged for further action and investigation, which subsequently led to the arrest of both men.

The prosecution was handled by Prosecuting Officer, Inspector Nurshafiqa Nyaie Ilin, while the accused were unrepresented.
