Elderly man in stone-throwing case to undergo psychiatric evaluation

KUCHING: An elderly man with a history of mental illness has been ordered to undergo a one-month psychiatric evaluation after being charged in the Magistrates’ Court today with smashing car windows by throwing stones at Batu Kawa.

Bujang Sanusi, 68, a holder of a ‘Person with Disabilities’ (OKU) card, nodded in understanding as the two charges were read before Magistrate Mason Jaro Lenya Barayan.

According to the first charge, he is accused of committing mischief by damaging the rear window of a Perodua Axia belonging to a 29-year-old woman, causing a loss of RM250.

He committed the offence in front of the Paragon factory, Jalan Batu Kawa, on June 2 at around 2:20 am.

For the second charge, he is accused of again committing mischief by smashing the front windscreen of a Toyota Hiace belonging to a 39-year-old woman, causing a loss of RM900.

He committed this offence by the roadside near Kampung Sinar Budi Lama, Jalan Batu Kawa, on July 5 at around 7:25 pm.

Both charges fall under Section 427 of the Penal Code, which carries a punishment of imprisonment for not less than one year and not more than five years, or a fine, or both.

The prosecution was conducted by Prosecuting Officer, ASP Arman Ibrahim, while the accused was unrepresented.

According to previous media reports, on July 7, the man was arrested by police for allegedly throwing stones that broke the windows of vehicles passing along Jalan Batu Kawa.

Padawan District Police Chief, Superintendent Mohd Irwan Hafiz Md Radzi, said ten police reports had been received and the cases were classified under Section 427 of the Penal Code.

Several stones used by the man were also seized.

Meanwhile, the court fixed August 11 for case mention.
