KUCHING: A female gambling operator was sentenced to a fine of RM5,000, in default two months’ imprisonment, by the Magistrates’ Court here for carrying out top up for online gambling activities in public.
Dai Siaw Hung, 34, pleaded guilty to a charge on Tuesday (Nov 7), which was read out by an interpreter in front of Magistrate Zubaidah Sharkawi.
According to the charge, she was charged under Section 7(2) of the Open House Gambling Act 1953, which carries a fine of not less than RM5,000 or imprisonment of not more than six months or both, if convicted.
Based on the facts of the case, at the time of the incident, the complainant, a police officer, led his team to conduct an Ops Dadu raid on the sidewalk of an unnamed shop in Bandar Baru Samariang, last September.
The raid resulted in the arrest of a woman who was topping up online gambling using the WhatsApp app.
Upon the arrest, the officers confiscated a mobile phone and cash amounting to RM110.
As a result of the investigation, a gambling expert’s report confirmed that the confiscated item, which is the mobile phone, was indeed used for gambling activities.
The prosecution of the case was handled by prosecuting officer Inspector Nur Shafiqa Nyaie Ilin while the accused was not represented by a lawyer.
