Fined RM2,500 for disposing of stolen property

KUCHING: The Magistrate’s Court here today (Mar 1) imposed a fine of RM2,500 or four months’ imprisonment on a man for disposing of stolen property, namely, three bonsai trees, by selling them to someone else.

Michael, 45, pleaded guilty to a charge under Section 414 of the Penal Code read out in the presence of Magistrate Syarifah Fatimah Azura Wan Ali.

According to the charge, he was accused of intentionally disposing of the three bonsai trees belonging to a 35-year-old woman.

He committed the offence at a premises at Jalan Landeh  around 8 am on February 25 last year.

Based on the facts of the case, during the incident, the complainant’s mother informed the complainant of the theft.  

The complainant then checked the Closed Circuit Television (CCTV) recording and found an unknown man had stolen all the pots of bonsai trees.

A police report was made by the complainant, leading to the arrest of the accused at a house on Jalan Datuk Stephen Yong, around 4 pm on the same day.

The estimated loss suffered by the complainant was around RM3,000.

The investigation found that the accused had disposed of the stolen property by selling them to someone else for RM250.

The prosecution was handled by Prosecuting Officer Inspector Nur Shafiqa Nyaie Ilin while the accused was not represented by a lawyer.
