Firm fined RM30,000 for failing to ensure vehicle safety

KAPIT: The Sessions Court here has sentenced a logging company to a fine of RM30,000 or 20 months’ imprisonment for failing to ensure the safety of a transport vehicle, which led to the death of a worker in an accident.

According to a media statement from the Department of Occupational Safety and Health (DOSH) Sarawak, a representative of Shin Yang Sdn Bhd pleaded guilty to three charges read before Judge Musyiri Peet.

For the first charge, the company was charged under Section 15(1) of the Occupational Safety and Health Act (OSHA) 1994.

The company failed to ensure that the logs on the transport vehicle were secured safely, resulting in the fatal accident of a 47-year-old local worker.

The incident occurred in the Belaga District at around 7.30 am on Sept 15, 2022.

For this offence, the company was fined RM20,000 or eight months’ imprisonment.

For the second and third charges, the company was charged under Regulation 5(1)(a)(aa) and Regulation 5(1)(a)(bb) of the Occupational Safety and Health (Notification of Accidents, Dangerous Occurrences, Occupational Poisoning, and Occupational Diseases) Regulations (NADOPOD) 2004.

These charges were due to the company’s failure to immediately notify the nearest DOSH office about the accident.

Judge Musyiri imposed a fine of RM5,000 or six months’ imprisonment for each of the second and third charges.

The prosecution was conducted by DOSH prosecution officer Devyclay Pius, while the case was investigated by three investigating officers, namely, Muhamad Firdaus Bachok, Mohamad Azril Abdul Jalil, and Mohamad Shahbani Che Mid.
