KUCHING: A 39-year-old man was sentenced to six months’ imprisonment by the Magistrates’ Court here today for possessing 0.10 gramme of methamphetamine.
Mohd Tahir Maan pleaded guilty before Magistrate Nursyaheeqa Nazwa Radzali after the amended charge was read to him.
The court heard that the accused committed the offence at about 1:30 pm on April 15, in the living room of a house at Kampung Astana Lot, Petra Jaya.
Facts of the case revealed that a police team from the Kuching District Police Headquarters Narcotics Criminal Investigation Division went to the house and detained the accused, who was seated on a chair in the living room.
The police identified themselves and conducted a physical search on the accused and the surrounding area.
During the search, the accused was seen acting nervously while clutching something in his right hand.
A search of his hand uncovered a piece of green straw containing crystalline chunks suspected to be methamphetamine.
The item was seized and the accused was arrested under Section 12(2) of the Dangerous Drugs Act 1952.
The court was also informed that the seized substance was sent to the Chemistry Department laboratory in Kuching for analysis on April 16.
A chemical analysis report dated May 28 confirmed that the substance was methamphetamine with a net weight of 0.10 gramme.
Methamphetamine is listed in the First Schedule of the Dangerous Drugs Act 1952.
Tahir was charged under Section 12(2) of the Act, punishable under Section 12(3), which provides for a fine of up to RM100,000, imprisonment for up to five years, or both upon conviction.
The accused was unrepresented, while Deputy Public Prosecutor, Muhammad Aidil Akmal Sharidan, appeared for the prosecution.
