KUCHING: Four local men who were involved in a fight in front of a 24-hour convenience store last Sunday were each fined RM3,000 in default of three months’ jail by the Magistrate’s Court here today.
Bryan Fong Hung Xuan, 21, Michael Entalang Lium, 27, Sim Chit Sin, 31, and Lee Khai Sieng, 36, pleaded guilty to a charge which was read together before Magistrate Mason Jaro Lenya Barayan.
They were jointly charged with fighting using weapons like samurai swords and knives, in front of a 24-hour convenience store, Jalan Datuk Stephen Yong, at around 1 am on June 9.
As such, all the accused were charged according to Section 148 of the Penal Code and read together with Section 34 of the same code.
Based on the facts of the case, at the time of the incident, the complainant who was a policeman along with his colleagues were conducting a crime prevention patrol and chance upon all the accused who were engaging in a fight.
All of them were carrying weapons like pieces of wood, samurai swords and knives.
As a result of the incident, one victim suffered injuries to the back of the head and the fingers of the right hand.
The fight was resolved and the weapons used were also confiscated including a Hyundai Atos vehicle.
Further investigation found that all the accused had committed an offence under Section 148 of the Penal Code for causing a fight.
Prosecuting Officer Inspector Merylene Lindan Andrew Mang prosecuted the case while Bryan Fong was represented by counsel Russell Lim and Khai Sieng was represented by counsel Patrick Voon.
The other two accused were not represented by a legal counsel.
