KUCHING: The High Court here upheld the seven-year jail term and three strokes of the cane imposed on two men for seriously injuring their acquaintance in Bau two years ago.
Judge Zaleha Mohd Yusuf Pan dismissed the appeal by Kuan Boon Lung, 25, and Larrie Liew Yu Nan, 28, after finding no reason to disturb the Sessions Court’s decision.
In delivering her judgment, she said the court had considered the evidence presented, the seriousness of the offence, the appellants’ records, and submissions from both parties before affirming the sentence.
Prosecution was led by Deputy Public Prosecutor, Aida Nurdiana Che Kamarulzaman, while both appellants were represented by counsel, Lim Lian Kee.
On April 11 2023, the Sessions Court sentenced the duo after they pleaded guilty to causing grievous hurt under Section 326 of the Penal Code, read together with Section 34.
According to the charge sheet, the pair intentionally injured a 30-year-old man using a wooden stick at a house in Jalan Buso, Bau, around 10:00 pm on March 25, 2023.
Case facts stated that the victim was attacked while he was resting at home and later required hospital treatment for serious injuries.
A police report lodged afterwards led to the arrests of the two men on March 27 and 28.
Investigations stated that the assault stemmed from a dispute over unpaid debt.
