Intoxicated man jailed two months for punching a worker

KUCHING: A 41-year-old man was sentenced to two months’ imprisonment by the Magistrate’s Court here today (June 19) for punching another man in a parking lot last week while he was drunk.

Magistrate Ling Hui Chuan handed down the sentence on Mas Faizal Mohamad Sajili after he pleaded guilty to a charge under Section 323 of the Penal Code.

The offence under Section 323 of the Penal Code carries a maximum imprisonment of one year, or a fine of up to RM2,000, or both, upon conviction.

The court ordered the prison sentence to run from the date of conviction (June 19).

According to the charge, Mas Faizal had on June 15 about 11:30 am at a parking lot under an eatery near Jalan Masjid here, voluntarily caused hurt to the 39-year-old victim by punching him in the face.

The facts of the case revealed that the victim was preparing to remove work equipment from the boot of his employer’s black Mitsubishi Triton to install a new CCTV system at the parking lot when he was suddenly approached by the accused.

The accused, who appeared to be intoxicated, challenged the victim to a fight without provocation and punched him in the face.

The fight was broken up by the victim’s employer and a female cleaner at the location.

The victim later lodged a police report at the Sentral Police Station, complaining of pain in his face and lip.

Police from a crime prevention patrol unit responded to a public tip-off about a fight at the public parking area.

Upon arrival, they detained a man believed to have started the altercation.

The accused, who was in a drunken state, initially put up a struggle before being subdued and brought to the Sentral Police Station for further action.

The investigation concluded that Mas Faizal had intentionally caused injury to the victim.

Deputy Public Prosecutor, Muhammad Afiq Safly Nor Kazly, prosecuted while the accused was unrepresented.
