KUCHING: The Magistrate’s Court here sentenced a 57-year-old man to nine months in prison for assaulting his wife after she asked for the car keys to check the battery he had removed.
Chan Hua Boo pleaded guilty before Magistrate Ling Hui Chuan to a charge under Section 323 of the Penal Code, read together with Section 326A of the same Code, for voluntarily causing hurt to his 40-year-old wife.
If convicted, he could be imprisoned for a term up to a year or fined up to RM2,000 or both at once.
The offence occurred at a rented house in Jalan Traffic Garden around 8pm on May 26, 2022.
According to the case facts, the victim was in the bedroom when she noticed through a closed-circuit television (CCTV) feed on her phone that her husband had taken the car battery from the bonnet.
She then asked him for the car keys to inspect her vehicle, which triggered Chan to punch her on the left side of the head, back of her neck, and her left eye, resulting in swelling.
Fearing for her safety and to prevent a repeat of the assault, the victim lodged a police report.
She was later sent to the hospital, where a medical officer confirmed injuries to the left side of her face.
The incident was also witnessed by another tenant staying in the same house.
Chan was arrested on May 28, 2022, around 2.20pm by the roadside along Jalan Stampin Baru.
Deputy Public Prosecutor Adriana Maisarah Mohd Farid prosecuted, while Chan was unrepresented by counsel.
