SARIKEI: A 43-year-old man was charged at the Magistrates’ Court here today with the murder of an elderly man in an incident that allegedly occurred in Julau last month.
The charge, read before Magistrate Stella Augustine Druce, was framed under Section 302 of the Penal Code, which carries the death penalty or imprisonment of between 30 and 40 years, along with a minimum of 12 strokes of the cane if the death penalty is not imposed upon conviction.
The accused is alleged to have committed the offence in Sungai Rau Entabai, Julau, at about 11 am on Feb 24.
The provision relates to murder with the intention of causing death.
In the same proceedings, the accused was also charged under Section 506 of the Penal Code for criminal intimidation against the deceased’s child, as well as under Section 39 of the Arms Act 1960 for discharging a firearm other than at a shooting range.
No bail was offered as the offence under Section 302 is classified as non-bailable.
The accused will remain in custody pending the disposal of the case.
Magistrate Stella fixed May 5 for further mention of the case.
