KUALA LUMPUR: Police probing alleged malicious content directed towards the Prime Minister’s wife, Datuk Seri Dr Wan Azizah Wan Ismail have now referred their investigation papers to the Attorney General.
Police asserted that the investigation was conducted professionally in accordance with procedures established by law.
“The investigation papers have been referred to the office of the attorney general in accordance with article 145(3) of the federal constitution and are still under review,” said Bukit Aman Criminal Investigation Department Director Datuk Seri Mohd Shuhaily Mohd Zaid in a statement Wednesday.
He dismissed claims by certain parties with regard to the failure to answer questions posed by investigating officers during a recording of conversation taken under Section 112 of the criminal procedure code.
“The reluctance to cooperate is viewed in the context of a failure to provide information regarding access to computer data as per the provisions of Section 116b of the criminal procedure code and Section 249 of the Communications and Multimedia Act 1998,” he said.
“Under these provisions, a police officer conducting a search shall be granted access to computer data, including passwords, encryption keys, decryption keys, software, or hardware required, and any other means necessary to enable understanding of computer data.”
On October 30, social media content provider Syarul Ema Rena Abu Samah, also known as ‘Ratu Naga,’ appeared at Bukit Aman to provide a statement regarding an Instagram and TikTok post that was alleged to have defamed the Prime Minister’s wife.
Accompanied by her lawyer, Zaid Malek, Syarul Ema arrived at 12.45 pm to provide her statement to Bukit Aman’s classified crime investigation unit, as the police had previously summoned her from Perikatan Nasional to do so.
Inspector-General of Police Tan Sri Razarudin Husain verified that Syarul Ema was at Bukit Aman to provide her statement.
“Her statement was recorded today (Oct 30) …33 questions were asked but she did not answer. Police also seized her handphone and SIM card,” he told Bernama when contacted.
Razarudin stated that the police were unable to gather any information concerning the case due to the suspect’s lack of cooperation, which constitutes an offence under Section 249 of the Communications and Multimedia Act 1998.
On October 22, Parti Keadilan Rakyat (PKR) in Bandar Tun Razak filed a police report against three social media users for allegedly posting defamatory content against Dr. Wan Azizah, who also serves as the Member of Parliament for Bandar Tun Razak.
