SIBU: A 58-year-old man was jailed a total of 32 years by the Kapit Sessions Court on Wednesday (Mar 5) for incest.
He pleaded guilty to three charges of incest by having sexual intercourse with his teenage granddaughter.
Judge Musyiri Peet imposed 10 years’ jail on Kunsil Moto from Nanga Banjor, Katibas, Song district for the first two charges and 12 years’ jail for the third charge after he pleaded guilty to the three charges read and explained to him through an interpreter.
The sentences were to run consecutively, with effect from the date of accused’s arrest on Dec 16, 2024.
Kunsil was indicted on the first charge for having sexual intercourse with his granddaughter aged 14 years 10 months.
The incident took place at a longhouse in Nanga Banjor, Katibas in Song district at about 10.30 pm on April, 2023.
The second charge against him stated that he committed the same offence on the victim at about 11 pm on May, 2023 at the same venue.
He was slapped with the third charge of repeating similar offence at about 10 pm on May, 2024 at the same venue.
The offence is framed under Section 376B(1) of the Penal Code read together with section 16(1) of the Sexual offences Against Children Act 2017, which upon conviction, provides for an imprisonment of not less than 10 years and not more than 30 years, and shall also be whipped.
According to facts of the case, on Dec 16, 2024, at about 11 am, at Song District Health Clinic, a medical officer (complainant) who attended to the victim found that the underage victim had been pregnant for about 33 weeks.
The complainant subsequently lodged a police report.
Acting on information received, a team of police from Song arrested to assist in the investigation.
The case was prosecuted by DPP Cynthia Emmelda Jerry while the accused was unrepresented.
