KUCHING: A local man was fined RM900 or sentenced to three months in prison by the Magistrate’s Court here today after breaking the side mirror of a car, owned by a male victim, using an iron rod.
Don Hiroshee Philip, 29, pleaded guilty to charges under Section 427 of the Penal Code, as read by the interpreter in front of Magistrate Zubaidah Sharkawi.
According to the charge, he allegedly committed the offense outside a house in Kampung Stutong at around 3.40 pm on October 1.
If found guilty, he could face imprisonment for no less than one year and not more than five years, a fine, or both.
According to the case details, during the incident, the complainant, while sitting outside his house, reprimanded a man known as ‘debu’ for speeding in the residential area.
Following the reprimand, the accused opened his car window and glared at the complainant, appearing displeased with the admonishment.
Around 4.10 pm on the same day, the accused returned in a car, accompanied by another vehicle driven by a different man.
The accused and his companion exited their vehicle, and one of them, wielding an iron rod, hurled it towards the complainant’s house.
Furthermore, the accused, also armed with an iron rod, shattered the front side window of the car belonging to the complainant’s brother, causing damages estimated at RM300.
Subsequently, the complainant filed a police report, prompting further action and investigation.
The subsequent investigation confirmed that the accused had thrown the iron rod and damaged the side mirror of the car belonging to the complainant’s brother.
The prosecution was conducted by Prosecutor Inspector Nur Shafiqa Nyaie Ilin, and the accused had no legal representation.
