KUCHING: A 44-year-old man was fined RM6,100, in default of 13 months’ imprisonment, by the Magistrate’s Court here today (Nov 4) for possessing and consuming methamphetamine three years ago.
Magistrate Mason Jaro Lenya Barayan meted out the sentence on the accused, identified as Isyhak, after he pleaded guilty to two charges under the Dangerous Drugs Act 1952.
For the first charge, Isyhak was found guilty of possessing 0.99 grams of methamphetamine at a house in Taman Hui Sing around 6.54 pm on Oct 3, 2022.
The offence, framed under Section 12(2) of the Dangerous Drugs Act 1952 and punishable under Section 12(3) of the same Act, carries a fine of up to RM100,000 or imprisonment for up to five years, or both.
For the second charge, he was found guilty of consuming amphetamine and methamphetamine, an offence under Section 15(1)(a) of the same Act, which carries a penalty of up to two years in prison, a fine not exceeding RM5,000, and immediate supervision for up to three years.
Based on the facts of the case, a police patrol team detained the accused after residents reported him wandering suspiciously around the neighbourhood.
A search on the accused led to the discovery of a transparent plastic packet containing crystal-like substances, which he voluntarily handed over to the police.
A chemist’s report later confirmed the substance to be methamphetamine weighing 0.99 grams, while a urine test also tested positive for amphetamine and methamphetamine.
The case was handled by Deputy Public Prosecutor Muhammad Aidil Akmal Sharidan, while the accused was unrepresented.
