SIBU: The Sessions Court here fined a man RM11,000, in default three months’ imprisonment, for three offences.
In the first charge on Monday (April 17), Judge Marutin Pagan imposed a RM1,000 fine, in default one month’s imprisonment, on Sia Pung Huk, 38, from Jalan Ulu Sungai Merah, for having two products for sale containing scheduled poisons in the First Schedule of the Poisons Act 1952, without a valid licence.
He violated Section 13(a) of the Poisons Act 1952, which provides for a fine of up to RM3,000 or one year’s imprisonment, or both.
He was fined RM5,000, in default one month’s imprisonment, on the second charge for having 21 unregistered products for sale, thereby contravening Regulation 7(1)(a) of the Control of Drugs and Cosmetic Regulations 1984, which provides a maximum fine of RM25,000 or three years’ imprisonment, or both.
Sia was also fined RM5,000, in default of one month’s imprisonment, on the third charge of violating Regulation 18A(1)(a) of the Control of Drugs and Cosmetics Regulations 1984 – possession for sale of two products which are not notified cosmetics, an offence which also carries a maximum fine of RM25,000 or three years in prison, or both.
All the offences were committed at his shoplot in Jalan Tunku Abdul Rahman at about 11.05am on July 4 last year.
The products were seized by enforcement officers and later, a chemist report confirmed that two seized products—Kopi Pejuang and Kopi Rindu—were found to contain scheduled poisons specified in the first schedule of the Poisons Act 1952.
Certificates under the Regulation 9(4) of the Control of Drugs and Cosmetics Regulations 1984 issued by the Drug Control Authority, Ministry of Health Malaysia dated Nov 4, 2022 confirmed that the 21 seized products were not registered products on the day of inspection.
A verification report of Cosmetic Notification Status issued by the National Pharmaceutical Reglatory Agency dated Nov 4, 2022 confirmed that the other two seized products were not notified cosmetics on the day of inspection.
Upon investigation, it was also found that no poison licence for the year 2022 was issued to the accused.
