Man fined RM1,000 for causing hurt to another in dispute

KUCHING: A man was fined RM1,000, in default one month’s imprisonment, by the Magistrates’ Court here on Wednesday (Aug 19) after pleading guilty to voluntarily causing hurt to another man during a dispute at a cemetery in Siburan.

Jospomon Rine, 46, pleaded guilty to the charge before Magistrate Nursyaheewa Nazwa Radzali.

He was charged under Section 323 of the Penal Code, which carries a maximum imprisonment term of one year, or a fine of up to RM2,000, or both, upon conviction.

The court heard that the incident occurred at about 6pm on Aug 16 at Kampung Prutan, Siburan.

According to the facts of the case, the incident stemmed from the accused’s dissatisfaction with the 35-year-old victim over a car parked near a cemetery and allegations that the victim had taken donation money placed at the grave of the accused’s child.

The accused approached the victim and attempted to attack him with a metal rod before punching him.

He then ordered the victim to move his vehicle before using a Toyota Hilux to block the vehicle from leaving the area and contacting his friend to come to the scene.

After the friend arrived, the latter allegedly used a helmet to smash the right side of the windscreen of the victim’s Proton Saga.

The accused then punched the victim in the right side of his face again.

In a separate case before Magistrate Ling Hui Chuan, Desmond Luyu, 40, was fined RM4,500, in default eight months’ imprisonment, after pleading guilty to intentionally damaging the same Proton Saga.

Desmond was charged under Section 426 of the Penal Code, which provides for a maximum five-year jail term, or a fine, or both upon conviction.

The court heard that at about 6.30pm on Aug 16, the victim was inside the Proton Saga, at the cemetery in, Kampung Prutan.

The vehicle was registered in the name of the victim’s wife, and was being used by him with her permission.

The windscreen was in good condition before the incident.

Desmond, who had been contacted by Jospomon, arrived at the scene and ordered the victim to get out of the vehicle.

When the victim remained inside and attempted to reverse the car to leave, Desmond allegedly used a helmet to deliberately strike the right side of the windscreen.

The windscreen shattered and scratches were also found on the front portion of the vehicle.

Deputy public prosecutor Muhammad Aidil Akmal Sharidan and Muhammad Afiq Safly Nor Kazly prosecuted the cases separately while Jospomon and Desmond were unrepresented.
