KUCHING: A 30-year-old man was fined RM1,500, in default five month’s imprisonment, by the Magistrates’ Court here today for selling his sister’s table fan, knowing it was stolen property, earlier this month.

Mohd Saiful Dris pleaded guilty to the charge read before Magistrate Nursyaheeqa Nazwa Radzali.

He was charged under Section 414 of the Penal Code, which provides for imprisonment of up to seven years and a fine upon conviction.

According to the charge sheet, he committed the offence at about 10am on Feb 5 by voluntarily assisting in disposing of his sister’s fan, knowing it to be stolen property.

The facts of the case revealed that at about 5.30pm on the same day at Jalan Matang, the complainant realised that the rear door grille of her house had been forcibly opened and damaged.

Upon inspection, she found that a table fan and a TV decoder were missing.

As a result of the incident and the damage caused, the complainant suffered losses estimated at RM1,000.

She suspected her younger brother, Mohd Saiful, of breaking into her house.

A police report was subsequently lodged, and he was arrested on Feb 17 at about 6.45pm by officers from the Task Force Branch of the Padawan police headquarters (IPD).

Mohd Saiful later led police to recover the stolen item, which consisted of one unit of a Pensonic table fan.

Investigations revealed that he had broken into the house by damaging the rear kitchen door and grille before stealing the table fan belonging to his sister.

He later sold the fan for RM30. The seized item was identified by the complainant.

The accused had committed an offence under Section 414 of the Penal Code for disposing of stolen property.

Deputy Public Prosecutor Ahmad Fauzulufti Suriani prosecuted while Mohd Saiful was unrepresented.
