KUCHING: A 39-year-old man was fined RM2,000 or two months’ imprisonment by the Magistrates’ Court here today for gambling online at a public premises earlier this month.
Magistrate Ling Hui Chuan imposed the sentence on Jamali Daud after he pleaded guilty to the charge under Section 7(2) of the Common Gaming Houses Act 1953, which provides for a fine of up to RM5,000, imprisonment for up to six months, or both upon conviction.
According to the facts of the case, Jamali was found gambling using a mobile phone at a premises near Lorong Persiaran Bandar Batu Kawah 1C, MJC here, at about 1:30 pm on July 4.
Police from the Criminal Investigation Department of Padawan District Police Headquarters, conducted an inspection at the premise.
During the inspection, police found the accused seated at a table and discovered a mobile phone containing elements of online gambling.
Police subsequently arrested Jamali and seized a Sony Xperia mobile phone, a piece of paper containing an identification number and password, as well as RM50 cash.
Investigations found that Jamali admitted to being at the premises and participating in online gambling using the mobile phone when he was arrested.
Deputy Public Prosecutor, Muhammad Afiq Safly Nor Kazly, appeared for the prosecution, while the accused was unrepresented.
