Man gets jail term for abusing, threatening to kill wife

KUCHING: A drug addict was sentenced to 24 months imprisonment by the Magistrate Court for abusing and threatening to kill his wife after suspecting that she was having an affair with another man two years ago.

Kamarulariffin Abdul Rahman, 39, pleaded guilty to two charges midway through the trial before Magistrate Mason Jaro Lenya Barayan today.

He was charged under Section 323 of the Penal Code, read together with Section 326A of the Penal Code, for intentionally causing injuries to his 39-year-old wife on the body and face.

For the second charge, he was charged under Section 506 of the Penal Code for criminally threatening to kill the victim.

He committed the offences at a flat along Jalan Menggis at about 11.40 pm on Sept 12, 2024.

According to the facts of the case, on the day of the incident, the accused confiscated the victim’s phone before punching and kicking her body and slapping her face.

The victim, who remained patience, kept silent about her husband’s actions and did not immediately report the incident to the authorities.

However, on Sept 14, 2024, the accused again abused his wife while uttering threats to kill her.

Following the repeated incident, the victim fled and went to the hospital to seek treatment before lodging a police report.

It was understood that the incident occurred because the accused suspected that his wife was having a relationship with another man.

On July 5 last year, during ‘Ops Kesan’ at about 4 pm, the accused was arrested by police while hiding in a room at a flat in Taman Sri Wangi.

During the arrest, an initial urine screening found that the accused tested positive for drugs.

Investigations revealed that the accused had caused injuries to the victim and had threatened to kill her.

The prosecution was conducted by Deputy Public Prosecutor Muhammad Aidil Akmal Sharidan, while the accused was not represented by a lawyer.

The case was investigated by investigating officer Inspector Nur Ain Wong Abdullah.

Earlier, the accused was sentenced to four months imprisonment after pleading guilty under Section 15(1)(a) of the Dangerous Drugs Act 1952, punishable under Section 15(1) of the same Act, for involvement in drug abuse activities.
