Man jailed 12 months for assaulting brother after cigarette refusal

KUCHING: A 27-year-old man was sentenced to 12 months’ jail by the Magistrates’ Court here today for assaulting and threatening his elder brother after he was refused a cigarette.

Mohd Suhellsa pleaded guilty to two charges before Magistrate Mason Jaro Lenya Barayan.

For the first charge, he was convicted under Section 323 of the Penal Code for causing hurt by punching the 31-year-old victim in the face, leaving bruises.

He was also convicted under Section 506 of the Penal Code for issuing criminal threats to harm the same victim.

The offences were committed at their home in Kampung Kolong 2 at about 9:00 am on December 5.

Mason Jaro ordered the accused to serve 12 months’ imprisonment for each charge, to run concurrently.

According to the prosecution, the accused suddenly punched the victim in the head during the incident and threatened to “break” his face if he reported the matter to the police.

Investigations later confirmed that the accused used his hands and feet to assault his brother, and also issued criminal threats.

The confrontation stemmed from the victim’s refusal to give the accused a cigarette.

Deputy Public Prosecutor, Muhammad Aidil Akmal Sharidan, prosecuted, while the accused was not represented.
