Man jailed 12 months for damaging brother’s house

KUCHING: A 38-year-old man was sentenced to 12 months’ imprisonment by the Magistrates’ Court here for committing mischief by damaging parts of a private property.

Sopian Abdul Rahman, who pleaded guilty, was handed the sentence by Magistrate Mason Jaro Lenya Barayan following proceedings in court.

He was charged under Section 426 of the Penal Code, which provides for a jail term of up to five years, or a fine, or both upon conviction.

According to the charge, the accused committed the offence on March 24 at 9.58 pm at a house in Jalan Cenderawasih, Semerah Padi Phase 2, Kuching.

He was accused of causing damage to the wall, pole and window of the house.

Facts of the case revealed that earlier, at about 2.35 am on the same day, the complainant, identified as Sopian’s older brother, was at home when the accused suddenly ran amok.

Armed with a parang, he damaged various items in the house, including the walls, a room door and house pillars.

Following a report of a man behaving aggressively, a police patrol team was dispatched to the scene.

Sopian was arrested at 1.20 am and brought to the Gita Police Station for further action.

Investigations found that the accused had intentionally caused damage to parts of the house.

A urine test conducted on him also returned positive for amphetamine and methamphetamine.

The prosecution was conducted by Deputy Public Prosecutor, Ruvinasani Pandian. Sopian was unrepresented.
