KUCHING: A man was sentenced to 13 months’ imprisonment for intentionally injuring and committing criminal intimidation to his younger brother.
Magistrate Ling Hui Chuan ordered Mohd Muzzakhir Malik, 29 to begin serving his sentence from February 2.
Muzzakhir pleaded guilty to both charges framed under Section 506 of the Penal Code and Sections 323 and 326A of the same code.
The offences carry a punishment of imprisonment for up to seven years, fine or both.
For the first charge, he committed criminal intimidation by threatening to break his younger brother’s head at Kampung Tanjung Bako on January 28 at about 10pm.
Meanwhile, for the second charge, he intentionally injured his younger brother on the face on the same day. He was arrested on January 29.
The incident stemmed from a dispute when the accused’s younger brother wanted to use a fan, following which the accused slammed it and a scuffle ensued.
The victim subsequently sustained injuries to his lip and left eye.
Muzzakir had also uttered threatening words, “kau ku pecah palak ko malam tok” (“I will break your head tonight”), which were heard by both the victim and the complainant, causing fear to the victim and the complainant.
A medical report found that the victim sustained bruises over his left periorbital and superficial abrasions over right upper inner lip.
