KUCHING: A 34-year-old man has been sentenced to 24 months’ imprisonment by the Magistrates’ Court here after pleading guilty to assaulting and threatening to kill his wife following a domestic dispute.
Magistrate Mason Jaro Lenya Barayan ordered the accused, Bong Jian Bin, to serve 12 months’ jail for the first charge and another 12 months for the second charge, with both sentences to run consecutively.
Bong pleaded guilty to voluntarily causing hurt to his wife under Section 323 of the Penal Code, read together with Section 326A of the same Code, as well as criminal intimidation under Section 506 of the Penal Code. He was unrepresented during the proceedings.
According to the facts of the case, the incident occurred at about 11.30 pm on Feb 27 at their residence in Jalan Arang.
The court heard that the accused had asked his wife for intimacy, but she declined.
This led to an argument between the couple. The accused then forcibly pulled down the complainant’s trousers and attempted to force himself on her.
When she resisted and kicked him, the accused became enraged and punched her twice on the head with his fist.
The victim attempted to shield her face with her hands but was struck on her hands as well.
The accused also threatened to kill his wife and her family if she refused to have a third child, causing the victim to fear for her safety and that of her family.
As a result of the assault, the complainant sustained soft tissue injuries to her head, left cheek and right hand, as confirmed by a medical report from Sarawak General Hospital (SGH).
The victim subsequently lodged a police report, leading to the accused’s arrest and prosecution.
