Man jailed, caned for beating wife over cigarette request

KUCHING: The Sessions Court here has sentenced an unemployed man to two years in prison and three strokes of the cane for assaulting his wife with a grass cutter cable shaft after she asked him for a cigarette.

Muhammad Azru’ul Abdul Aziz, 40, pleaded guilty before Judge Afidah Abdul Rahman to two amended charges under Sections 323 and 324 of the Penal Code, read together with Section 326A of the same code.

For the first charge, he was accused of punching his 39-year-old wife in the face. The second charge involved causing injury to his wife’s stomach with a grass cutter shaft cable.

The offence took place at their house in Kampung Stungkor Baru, Lundu, at around 3pm on Feb 5.

Judge Afidah sentenced the man to six months in prison for the first charge, and two years in prison and three strokes of the cane for the second charge. The sentences will run concurrently from his arrest date on Feb 7.

Based on the case facts, the incident began with a verbal argument when the victim asked for a cigarette. In anger, Azru’ul struck her left buttock with the grass cutter cable shaft.

He later apologised, but when his wife said she wanted to file a police report, he became aggressive again, punching her in the face and pulling her hair inside their car.

Feeling provoked by her intention to report him, Azru’ul drove her to the police station himself. The woman was later sent to the hospital, where a medical report confirmed she had suffered bruises.

He was later arrested by police on Feb 7 for further action. Investigations confirmed that the man intentionally caused harm using a grass cutter cable shaft.

Deputy public prosecutor Ng Xiang Hua prosecuted the case while Azru’ul was unrepresented by counsel.
