Man jailed for hitting brother-in-law with chair

SIBU: A 30-year-old man was on Monday (Dec 15) sentenced to three months’ imprisonment by the Magistrates’ Court here for assaulting his brother-in-law with a plastic chair.

Johnathanndot Janin from Tatau entered his plea of guilty to the charge read and explained to him through an interpreter whereby he understood and the consequences of his plea.

Magistrate Oon Kork Chern handed down the sentence after convicting him of the offence as charged.

The charge against him stated that he had voluntarily caused hurt to Hilllary Biegill Jalai, 20, by means of an instrument which used as a weapon of offence, to wit, a plastic chair, at Rumah Bantan, Batu 25, Sungai Pedalai in the district of Sibu, on Dec 9 at about 9.30pm.

The offence listed under Section 324 of the Penal Code provides up to 10 years’ imprisonment or fine or whipping or with any two of such punishments.

According to fact of the case, on Dec 9 at about 9.30pm, at Rumah Bantan, Batu 25, Sungai Pedalai, while Hillary (complainant) was at the ruai area of the house with his brother and nephew, his brother in-law identified as the accused arrived in an intoxicated state, sat beside him and appeared to be angry.

Suddenly the accused picked up a plastic chair and struck the complainant on the back and left arm, causing lacerations to those areas.

The complainant then lodged a police report for further action.

On the following day at about 4pm, Inspector Sudiman Sakuot led a team of police and arrested the accused at a room in the longhouse for further investigation.

Based on the investigation and available evidence, the accused had committed an offence punishable under Section 324 of the Penal Code.

The case was prosecuted by DPP KeshavaRao Tharma Raja while the accused, who was unrepresented by legal counsel, was ordered to serve the sentence from the date of his arrest.
