KUCHING: The Sessions Court here has sentenced a local man to 11 years in prison and five lashes of the cane for sexually assaulting his 13-year-old nephew last year.
The 40-year-old pleaded guilty before Judge Iris Awen Jon to two charges before the trial began today.
According to the first charge, he was charged under Section 14 (a) of the Sexual Offences Against Children Act 2017, read together with Section 14 of the same Act, for sexually assaulting a 13-year-old boy by touching his genitals.
For the second charge, he was charged under Section 14 (b) of the same Act, for sexually assaulting the same victim by inserting his genitals into his mouth.
The offences were committed in the living room and bedroom of a house on Jalan Sejijak, between 4 am and 6.30 am on May 2, 2023.
Iris Awen sentenced him to five years and six months in prison and two lashes of the cane for the first charge; and five years and six months in prison and three lashes of the cane for the second charge.
The court ordered that the prison sentences run consecutively.
According to the case facts, at around 9 am on the same day, the boy confided in his mother about his uncle’s heinous acts.
The man, who came from Sibu, was staying at the victim’s family home in Kuching. On the night of the incident, the parents were asleep while the victim was still playing games.
After hearing her son’s story, the mother immediately took him to the hospital for treatment, and filed a police report for further action.
Investigation found that the man had sexually assaulted the boy, and a medical examination found wounds on the victim’s genitals.
Deputy Public Prosecutor Ruvinasini Pandian prosecuted the case, while the man was represented by counsel.
