SIBU: A 50-year-old man was sentenced to eight years’ imprisonment and fined RM10,000, in default 10 months’ jail, by the Kapit Sessions Court on Wednesday for seriously assaulting his workmate with a machete.
Presiding Judge Musyiri Peet laid down the sentence after Mohammad Roslan Rosli from Lahad Datu, Sabah, pleaded guilty to the charge.
The accused understood the nature of the charge explained to him through an interpreter and the consequences of maintaining his plea of guilt.
The charge implicated in him stated that he had voluntarily caused grievous hurt to Genesis Rantai Ngadan outside the workers’ living quarters at Sungai Semawang Baleh, Kapit, on April 6 at about 6:00 pm, by means of a machete, which was used as a weapon of offence that was likely to cause death.
Thereby, he had committed an offence under Section 326 of the Penal Code, which, upon conviction, provides for an imprisonment of up to 20 years and is liable to fine or whipping.
According to fact of the case, on April 6 at about 6:00 pm, Genesis was heard screaming for help at a timber camp’s log pond, and was found seriously injured on part of his abdomen and was bleeding profusely following stabbing by his workmate.
Investigation revealed that the accused stabbed the victim with a machete because he was infuriated with the latter for hurling abusive words on him.
Medical examination on the victim stated that the victim sustained traumatic intestinal evisceration, slash injury with bowel evisceration and small bowel injury.
He was subsequently referred for surgical operation before admitted to Intensive Care Unit (ICU) for three days after which warded at Kapit hospital for another eight days.
The case was prosecuted by DPP Mark Kenneth Netto while the accused, who did not have any legal representation, has to serve another 10 months in prison for failing to pay the fine.
