SIBU: The Magistrates’ Court here today sentenced a youth to 15 months’ jail for stealing a motorcycle.
Magistrate Romario Jonoi meted out the sentence on Syliverstar Andy Johnny, 22, from Niah, Miri, after he pleaded guilty to the charge.
The charge against Andy stated that he had intentionally taken with dishonesty a Honda Wave motorcycle from Pirachis Lut without his consent, at Mile 22, Durin Road, at about 2:00 pm on June 18.
As such, he had committed an offence punishable under Section 379A(1) of the Penal Code which carries an imprisonment of not less than one year and not more than seven years, as well as liable to fine.
According to the fact of the case, on June 18 at about 2:00 pm, at Mile 22, Durin Road, the complainant (Pirachis) parked his motorcycle at the roadside.
However, when he returned from his farm in the vicinity, he found his machine missing which he believed to be stolen.
Estimating his loss at RM2,500, he lodged a police report for further action.
Acting on information received on June 25 at about 1:15 pm, a team of police led by Insp. Andrew Umdum arrested the accused for investigation purpose.
On the following day, the police confiscated the stolen motorcycle in Niah which was produced as exhibit in the case.
