KANGAR, Perlis: Perlis State Assembly Speaker, Rus’sele Eizan, has filed an application to strike out an originating summons filed by three former state assemblymen at the Kangar High Court here.

Lawyer representing Rus’sele, Wan Rohimi Wan Daud, said the application to strike out was filed on Monday.

Meanwhile, on the case management of the originating summons before Kangar High Court judge, Datuk Mohamad Abazafree Mohd Abbas, via Zoom earlier on Wednesday afternoon, Wan Rohimi said the court had set March 25 as the deadline for the plaintiffs to file their reply to Rus’sele’s affidavit.

“The court also fixed April 15 for the defendant’s further reply. Subsequently, a proceeding via Zoom before the High Court judge has been scheduled for April 16 to set the hearing of the application and related instructions,” he said in a brief statement to BERNAMA on Wednesday night.

On Jan 2, the three former state assemblymen – Mohd Ridzuan Hashim (Guar Sanji), Fakhrul Anwar Ismail (Bintong) and Saad Seman (Chuping) – filed an originating summons against Rus’sele over his declaration of casual vacancies in the seats they formerly represented.

On Dec 25 last year, Rus’sele announced that casual vacancies had occurred in the Chuping, Bintong and Guar Sanji seats after the membership of the three PAS assemblymen for those constituencies ceased with immediate effect in accordance with Clause (1)(a)(ii) of Article 50A of the Perlis State Constitution.

The decision followed a statement by PAS president, Tan Sri Abdul Hadi Awang, on Dec 24 last year, informing that the memberships of the three assemblymen had ceased pursuant to Clause 76 and Clause 15A(1)(b) of the PAS Constitution (Amendment 2025). – BERNAMA
