KUCHING: The Sessions Court here sentenced a repeat drug offender to five years in prison and one stroke of the cane for abusing methamphetamine and amphetamine drugs.
Fedrick Steward Mancha, 34, entered the guilty plea after the charge was read before Judge Saiful Bahari Adzmi.
He was tested positive for the drugs during a urine screening conducted at Padawan Narcotics Crime Investigation Division (NCID) office at 1.45 pm on Dec 30, 2024.
The court was told that he had two prior convictions for similar offences committed on Jan 26 and Apr 19, 2022, under Section 15(1)(a) of the Dangerous Drugs Act 1952.
For the latest offence, he was charged under the same section and sentenced under Section 39C(1)(b) of the same Act, which provides for imprisonment of up to seven years and up to three lashes of the cane.
The court also ordered him to be placed under police supervision for two years upon completing his sentence.
According to the case facts, Fedrick was arrested after being suspected of repeated drug abuse activities. Both preliminary tests and pathology reports confirmed he tested positive for methamphetamine and amphetamine.
Deputy public prosecutor Ruvinasini Pandian prosecuted the case while Fedrick was unrepresented by counsel.
