KUCHING: A satay seller was on Tuesday charged with murdering an Indonesian man in Padawan last month.
No plea was recorded from the 35-year-old after the charge was read out before Magistrate Nursyaheeqa Nazwa Radzali.
He is facing a charge under Section 302 of the Penal Code, read together with Section 34 of the Code.
The offence is punishable by the death penalty but in the event the court does not impose the death sentence, it provides for imprisonment of between 30 and 40 years, and no less than 12 strokes of the cane on conviction.
According to the charge, the accused, together with another person who is still at large, intended to kill the 37-year-old Indonesian man.
The incident occurred at the side of Jalan Lumba Kuda Penrissen Lama, Padawan, between 1.47am and 2.37am on Nov 23.
Deputy Public Prosecutor Muhammad Afiq Safly Nor Kazly requested a fresh mention date as the autopsy report is still pending.
No bail was offered to the accused and the court set January 27 for the next mention.
The accused is represented by lawyer Daniel Ling.
