SIBU: A security guard was sentenced to 12 years’ imprisonment and three strokes of the cane by the Sessions Court here, today, for raping a teenage girl.
Judge Musyiri Peet convicted Muyang, 59, after he pleaded guilty to the charge, which he understood and the consequences of his guilty plea.
He was indicted for raping a 13-year-old girl in a bush under the Teku bridge between July 5 and 12, from 8am to 10am, thereby committing an offence under Sexction 376(2)(D) of the Penal Code which is punishable under Section 376 (2) of the same Code.
The offence provides for a jail term of not less than 10 years and not more than 30 years and liable to be punished with whipping, upon conviction.
In outlining facts of the case, deputy public prosecutor Cynthia Emmelda Jerry told the court that on July 16 at about 6.30pm at a rental house in Jalan Rantau Panjang, the victim informed her father that she was raped by a man who works as a security guard at the Teku Community Clinic.
On July 17 at about 12.15am, acting on information received, a police team detained the suspect at the Teku Community Clinic, Teku Road.
He was then brought to the Sibu Central Police Station for further action.
Police investigation revealed that on July 16, while the complainant was having breakfast with his friends at a coffee shop, he saw the accused taking his daughter across the street.
The complainant then stopped his daughter and was later informed by her that the accused had sex with her upon her return from school.
After having sexual intercourse, the accused gave her RM10 in cash.
Medical examination found that there were old tears in the tympanic membrane at the five and nine o’clock positions.
Hence investigation found that the accused had raped the victim.
In mitigation, the accused who was unrepresented, pleaded for a lighter punishment.
