KUCHING: A 15-year-old boy was ordered to serve a three-year sentence at Henry Gurney School Puncak Borneo after pleading guilty to a sexual offence, the Magistrate’s Court ruled today (Jan 27).
Magistrate Ling Hui Chuan made the decision after reviewing the youth’s social report submitted by the Social Welfare Department (JKM).
As part of the court’s order, the boy’s parents are required to visit him once a month in accordance with the Child Act 2001.
The teenager, a form three student, admitted to committing an offence under Section 376(1) of the Penal Code. The case involved a sexual relationship with a 14-year-old girl that resulted in her becoming pregnant.
According to the case facts, investigations revealed that the complainant and the accused were in a relationship.
During the investigation, the complainant admitted to having consensual sex with the accused.
The incident occurred around Feb, 2025, after the accused moved into the complainant’s house in a village following family problems.
The accused had also been chased away from the house by the complainant’s family but refused to leave due to his own family problems.
In Aug, 2025, the complainant was confirmed to be six months pregnant by a clinic after a health examination. Following the pregnancy, the accused initially refused to take responsibility, prompting the girl’s family to report the matter to the police.
The prosecution was conducted by Inspector Nurshafiqa Nyaie Ilin, and the accused was not represented by legal counsel during the proceedings.
Under Section 376(1) of the Penal Code, a conviction can carry a maximum sentence of 20 years’ imprisonment, in addition to caning.
