KUCHING: Two teenage lovers aged 15 and 16 were ordered to be placed at the Henry Gurney School, Puncak Borneo and Sekolah Tunas Bakti, Miri respectively by the Magistrates’ Court here, on Thursday (Nov 11), for dumping their newborn baby last August.
Magistrate Zaiton Anuar sentenced the duo after they pleaded guilty to the charges read to them.
The court ordered the accused to serve a sentence of three years as prescribed under Section 91(1)(f) of the Child Act 2001.
In addition, the court also ordered their parents or guardians to visit the offenders every two months for a period of three years as prescribed under Section 93(1)(d) of the Act.
According to the charge, the teens left their newborn baby girl in the motorcycle basket of a villager at Lorong 5A, Jalan Siol Kandis around 5am, on Aug 26.
They were charged under Section 317 of the Penal Code and read together with Section 34 of the same code.
If convicted, they could be sentenced to a maximum of seven years in prison or a fine or both.
According to the facts of the case, police received a report from a villager who informed that he found a baby girl wrapped in a pink cloth placed in his wife’s motorcycle basket.
On the same day, around 8.50am, a 15-year-old boy was arrested by the police.
In addition, a 16-year-old girl was detained at her residence around 10am.
The results of the examination and analysis by the Department of Chemistry Malaysia confirmed that the DNA of both the accused and the baby matched.
The prosecution of the case was handled by Insp Merylene Lindan Andrew Mang while the accused were unrepresented.
